1. ACCESS TO COURSES AND CONTENT

Pastiche Training will provide access to the distance learning program for the exclusive use of an enrolled individual. We will endeavour to allow uninterrupted access to your Distance Learning material; however access to the courses may be suspended or restricted due to circumstances beyond our control or violations of these terms and conditions. We reserve the right to change, modify, substitute or remove without notice any information in the material from time to time.

You acknowledge that no third party whose network or platform we use to supply Services to you (nor any officer, employee, contractor or agent of such third party) is in any way liable to you in connection with our Services.  This includes temporary incompatibility issues that may arise from platform upgrades (operating systems) that create unforeseen compatibility situations.

It is the responsibility of the learner to ensure they have the appropriate device, connectivity, applications, security features and a suitable environment to undertake their study. Pastiche Training cannot be responsible for deficiencies in any learner provided resources, or third party systems outside of its control.

1.1 All enrolments must use a unique email address to access content. Each account is for a single person. A name change on the account are permitted one time only, and is intended for the correction of upper/lower case or spelling only. 

Subsequent name changes will lock the account. (See section 4.3) The sharing of email addresses by multiple learners will disrupt the learner database by causing conflicts. Pastiche Training cannot be held responsible for lost data if more than one learner is enrolled using the same email address. 

1.2 Enrolled individuals in the Advanced Skin Analysis program will have access to the content for an eighteen (18) month period from the date of enrolment or until completion. (Whichever is sooner) Extensions can be arranged due to specific circumstances and are determined on a case by case basis. 

1.3 Enrolled individuals in any of the specialty (between 3-5 units of learning) courses will have access to the courses purchased for a three (3) month period from the date of purchase or until completion. (Whichever is sooner) Single unit courses have a maximum of one calendar month access. 

1.4 Enrolled individuals in the following courses will have access for one (1) calendar month.  
• Laser & IPL Safety – ‘Core of Knowledge’ – Level 4 
• Laser & IPL Hair Reduction & Skin Rejuvenation Level 3 (Per module)  
• Laser Tattoo & Benign Pigmented Blemish Removal – Level 4 (Per module) 

Courses uncompleted after 1 calendar month of inactivity, and with completion reminders unactioned will be considered abandoned and learning accounts will be disabled. Inactivity is defined by learners undertaking activity that is less than 10% of the course duration time over the 1 month period. 

1.5 Enrolled individuals in the assignment based Level 5 LSO and the practical components of level 4 Light based hair reduction and skin rejuvenation and Level 5 Laser Tattoo & Benign Pigmented Blemish Removal courses are provided four (4) calendar months access from the date of purchase or until completion. (Whichever is sooner). Extensions can be arranged due to specific circumstances and are determined on a case by case basis. Contact your team leader or course administrator to do this.  

1.6 Users who have completed courses in their library and no activity will be deactivated after 4 weeks. Activation will occur on enrolment in another course. Learners with incomplete courses (with no activity) for a period more than 4 weeks may be temporarily deactivated. Re-activation without charge occurs upon request for learners with active courses.  

If there is insufficient activity on a learner account while they are enrolled in a course that has a specific completion timeframe as a component of overall assessment; and they are overdue, then the learner account may be disabled with notice. Please contact your team leader to discuss re-activation.  

1.7 It is your responsibility to retain any content you download during your access period. Once your account expires, you will lose access to online content. Content access is only available if the course is still available via your dashboard and your account is active. 

1.8 Modules that are part of a learning path will be delivered in sequence. Access to modules in the learning path cannot be provided simultaneously and are part of a controlled sequence. 

1.9 To access the courses, you will need a compatible device, working Internet access, and compatible software capable of displaying HTML 5 media and read PDF files. You will need to have JavaScript and Cookies enabled on all devices used to access your learning. Your ability to use the distance learning program and the performance of the Service may be affected by these factors. Such system requirements are your responsibility.  

Most modern computers and tablets with current updates and relevant browser plug-ins are suitable. Please refer to the Course welcome and orientation information section of your course. Particular emphasis is on using devices with the iOS operating system, which may need additional plug-ins to access materials. 1.10 It will be your responsibility to ensure you have followed the instructions in the orientation section of the courses with regard to ensuring continued access via the saving of login URLs and corresponding passwords.

2. INTELLECTUAL PROPERTY/COPYRIGHT

2.1 The copyright in the material contained in the courses, together with the design, text and graphics and all software compilation belong to Pastiche Training or their content providers. All rights are reserved. None of this material may be reproduced, broadcast, displayed or redistributed without Pastiche Training’s written permission. You may, however, download or print copies for your own, non-commercial use. 

2.2 If you download the course material from our site, all the material and data are deemed to be licensed to you by Pastiche Training, for your personal, non-commercial use only. 

2.3 Pastiche Training does not transfer either the title or the intellectual property rights of the course and Pastiche Training retains full and complete title to the courses as well as all the intellectual property rights therein. 

2.4 You may not sell, redistribute, broadcast, reproduce or convert any of the material without a separate license to do so. 

2.5 Pastiche Training or its content providers owns all trademarks and logos and you may not copy or use them in any manner.

3. EXCLUSIONS OF LIABILITY

3.1 Pastiche Training will use reasonable endeavours to ensure that the data in the courses is accurate and to correct any errors or omissions as soon as practicable after being notified of them. 

3.2 To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained in the courses. We do not guarantee that the material will be fault free and do not accept liability for any errors or omissions. 

3.3 While all efforts are made to keep the website free of harmful code and viruses, we do not give any warranty that the website is free from viruses or anything else which may have a harmful effect on any technology. 

3.4 Pastiche Training makes no representation whatsoever regarding the content of any other websites, which you may access from the courses. 

3.5 A link to a non-Pastiche Training website does not mean that Pastiche Training endorses or accepts any responsibility for the content or use of such websites. 

3.6 To the greatest extent possible by law, the client must indemnify and hold harmless Pastiche Resources Ltd, its officers, employees, agents and content providers (indemnified persons) against all liabilities (including legal costs on a full indemnity basis) incurred by the indemnified person in connection with the provision of the service by Pastiche Training Ltd, except the liability arising from the direct negligence or default of any of the indemnified persons.

4. ASSESSMENT CONDUCT & LEARNER MALPRACTICE

4.1 The assessments are a test at which learners demonstrate their individual knowledge and skills of the subject they are studying. This is of particular importance where courses are of a professional compliance nature.  If learners – intentionally or unintentionally – act in such a way as to improve their assessment conditions compared to what was intended, they will be considered to be cheating to obtain an inaccurate assessment result. 

4.2 In the event of learners receiving direct help from someone else to obtain an undue advantage during an assessment, this also constitutes cheating.  

4.3 We have algorithms that can detect inconsistencies in normal patterns; including but not limited to:  analysis of time spent on individual modules, analysis of assessment scores relative to time spent with the materials, understanding of instructions and advisements relative to assessment scores, and name changing of accounts to obtain certification by fraudulent means. 

4.4 In the event of a learner triggering a notification of potential cheating, Pastiche Training, its affiliates and assessors reserve the right to conduct an enquiry to validate the knowledge of the learner before issuing any certifications. The learner will at this time have the opportunity to respond to the enquiry. 

4.5 If the suspicion of cheating is found to be justified, any certifications received pertaining to the breach will be cancelled and the learner will be disqualified from any further enrolment in education provided by Pastiche Training and its affiliates. In the case of compliance and regulatory certifications, the relevant authority will be notified of the withdrawal of the certification. 

4.6 In the event of an investigation of cheating being upheld, the learner waives their right to a refund of course fees already paid.

5. LEARNER PERFORMANCE

If training is purchased on behalf of or provided to a learner for either personal development or business compliance purposes, the learner agrees to allow Pastiche Training and its content provider partners share course progress and conduct information with the learner’s sponsor if requested.

This information will be limited to attendance, progress, grade scores and whether the learner performs within the time span allocated for the activity.

6. COMPETENCE/COGNITION POLICY

6.1 Individuals enrolled in courses provided by Pastiche Training should be proficient in spoken and written English, comprehension and expression, with particular emphasis on reading ability.  These courses include technical instructions, advice and recommendations. The ability to understand and follow these will be crucial to a successful completion of the courses. 

6.2 Pastiche Training cannot be held responsible for a learner’s failure to complete courses where language difficulties or the inability to comprehend materials, instructions and advice are evident. No refunds will be given if a learner does not complete a course for these reasons.

7. CANCELLATIONS

Courses purchased cannot be cancelled once commenced. You may however, transfer to another person if the progress through the course is less than 20%. Contact Pastiche Training to facilitate this action.

8. LICENSE FOR USE

Pastiche Training educational programs have been exclusively designed for, and licensed for individual use. Pastiche Training is able to track individual student progress, and verify commencement of the program. In the event of multiple users or sharing of the content to groups being detected, Pastiche Training reserves the right to disable access until the violation has been rectified. 9. PASSWORDS

Individuals enrolled in Pastiche Training distance learning programs should access their purchased courses with the user credentials and password provided with their confirmation.  Your login details are the methods used by us to identify you and so are very important.  The following protocols for your passwords include: 

9.1 Strong passwords will be enforced.  (1 upper case, 1 lowercase, 1 number, 1 special character with a minimum of 8 characters total)  

9.2 Password Expiration. Passwords will be valid for 90 days before they expire. 

9.3 Enforcement limit of previous passwords. Users will not be allowed to reuse of their 5 previous passwords. 

9.4 You are responsible for any complications or obstructions to your learning pathway caused by anyone using your password details. In the event of your password being disclosed to another individual, you must implement a change immediately. You may also request a password reset.  

Any information regarding someone other than you using your password details should be advised to Pastiche Training immediately.

10. PRIVACY & DATA USE POLICY

By agreeing to these terms and conditions, you agree to the terms of the Pastiche Privacy & Data Use Policy. Pastiche only holds your data in order to provide services to you. We do not share your data and we will not communicate with you unless it is related to education you are undertaking or undertaken. 11. GENERAL

Pastiche Training may modify these terms and conditions at any time by publishing the modified terms and conditions on the website.
